Switch Off Oil Contest (“Contest”) Terms and Conditions
1. SPONSOR
The Contest is sponsored by Superior Propane, a division of Superior Plus LP
(“Superior”), located at 700 Jamieson Pkwy, Unit 102, Cambridge, ON, N3C 4N6.
2. AGREEMENT TO TERMS AND CONDITIONS
By participating in the Contest, each participant
agrees to be fully and unconditionally bound by these official Terms and Conditions, and
represents and warrants that they meet the eligibility requirements set forth herein. In addition,
each participant agrees to accept the decisions of Superior as final and binding as it relates to
the Contest. The Contest is subject to all applicable federal, provincial, territorial and local laws.
3. ELIGIBILITY
The Contest is open exclusively to individuals that (a) are residents of Canada
(excluding Québec) and have reached the age of majority in their province or territory of
residence; and (b) are not current propane customers of Superior. Proof of age and identity
must be furnished to Superior upon request.
Employees of Superior, its parents, related or affiliated companies, departments, subsidiaries,
franchisees, suppliers, advertising and promotional agencies, contest administrators, or any
other parties engaged in the development, production or distribution of Contest materials or
those living in the same household as the foregoing are not eligible to participate in this Contest.
Superior reserves the right to disqualify any participant for any reason, including, but not limited
to, violation of these Terms and Conditions or infringement of the rights of a third party.
4. ENTRY PERIOD
The Contest runs from April 15, 2024 to June 30, 2024 (the “Entry Period”).
The Contest will end at 11:59:59 PM ET on June 30, 2024, after which time the Contest will be
closed and no further entries will be accepted.
5. HOW TO ENTER
To enter the Contest and be eligible for a chance to win, each participant
must (a) complete and submit the online form at www.superiorpropane.com/switch-off-oil-savings or via Facebook/Instagram (“Online Form”) during the Entry Period; or (b) have previously completed the Online
Form between October 15, 2023 and the start of the Entry Period. Such participants will
automatically receive one (1) entry into the Contest. All such Contest entrants will be eligible for
the Draw (as defined below).
No purchase is necessary to enter the Contest. Each participant may have only one entry. Any
attempt or suspected attempt to use robotic, automatic, programmed or otherwise illicit means
to enter the Contest, or any other methods not authorized by these Terms and Conditions (for
example, creating multiple accounts, identities or registrations), shall, in Superior’s sole
discretion, disqualify participants from entering and participating in the Contest. Entries that
contain false or incomplete information or that otherwise do not satisfy any or all of these Terms
and Conditions are void.
6. PRIZE
One (1) unit of Rinnai Propane Tankless Water Heater valued at approximately C$2,000
(the “Prize”) is available to be won.
The odds of winning depend on the number of eligible entries received. The Prize is not
transferable and must be accepted as awarded with no substitution of any kind or cash value.
Superior makes no representation or warranty of any kind concerning the appearance,
performance, or condition of the Prize. For greater certainty: (a) no contract with Superior is
required for the installation, maintenance, and servicing of, or the supply of propane to, the Prize (and the Prize does not include such services); and (b) a certified partner of Superior may
provide installation services as required and upon request, depending on the winner’s location
and in such partner’s sole discretion. Superior hereby reserves the right to substitute another
prize or component of a prize of equal or greater value, without liability, in the event that a Prize
cannot be awarded as described for any reason. The Prize will not be awarded if, for any
reason, there are no eligible entries in the Draw.
7. WINNER SELECTION
One (1) winner will be selected from all eligible entries by a random
draw (the “Draw”). The Draw will take place within seven (7) business days after the end of the
Entry Period at Superior’s office. Superior, or an employee, agent or other representative of
Superior will conduct the Draw and select the potential winner (“Selected Entrant”).
8. NOTIFICATION
A Selected Entrant will be notified within two (2) business days of the Draw
and will be contacted by email or phone provided at the time of entry into the Contest. Before
being declared a winner, the Selected Entrant will be required to (a) correctly answer a time-
limited mathematical skill-testing question, without aid or assistance; and (b) sign and return a
copy of Superior’s Declaration of Eligibility and Release Form (“Winner Release”). If a Selected
Entrant does not respond within seven (7) business days of such notification, does not correctly
answer the mathematical skill-testing question in the manner prescribed, does not sign and
return a copy of the Winner Release within seven (7) business days of such notification, does
not meet the eligibility criteria set out in these Terms and Conditions or otherwise is not in
compliance with these Terms and Conditions, or cannot accept the Prize, a new Selected
Entrant will be selected by random draw from the remaining eligible entries. Superior is not
responsible for the failure for any reason whatsoever of a Selected Entrant to receive a
notification or for Superior’s failure to receive a Selected Entrant’s response.
9. RELEASE AND INDEMNIFICATION
The winner must sign and return a copy of the Winner
Release to (i) confirm compliance with these Terms and Conditions; (ii) agree to accept the
Prize as awarded; (iii) release, discharge and hold harmless Superior, its departments and
agencies, parents, related and affiliated companies, subsidiaries, franchisees, advertising and
promotional agencies, counsel, marketing partners, and each of their respective directors,
officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries,
agents, artists, advisors, assignees, and all others associated with the administration,
development and execution of the Contest (“Released Parties”) from and against any and all
manners of action, causes of action, claims or demands, losses or injuries, suits, debts,
covenants, and contracts, including legal fees and expenses, whatsoever, including but not
limited to, claims based on or related to use or misuse of the Prize or any travel related thereto,
use of Contest entries by the Released Parties, negligence, breach of contract and fundamental
breach, failure of any third-party contractor or supplier used in connection with any aspect of the
Contest to perform or deliver any goods or services, any act of God or any other event beyond
the Released Parties’ control, any dissatisfaction of any kind by the winner with any aspect of
the Contest or the Prize as awarded, and liability for physical injury, death or property damage
arising out of the entrant’s participation in the Contest or the acceptance and/or exercise by the
entrant of the Prize as awarded; and (iv) indemnify the Released Parties against any loss,
damage or expense, including legal fees, that any of the Released Parties may suffer or incur
as a result of any non-compliance by such winner with any of these Terms and Conditions or
participation in the Contest and/or in connection with the acceptance and/or exercise by such
winner of the Prize, and the use of entries by the Released Parties.
The Released Parties are not responsible for: (a) incorrect or inaccurate entry information that
may affect a person’s ability to participate in the Contest or be awarded the Prize, including but
not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail
failures, omission, or any combination thereof, and entries that fail to fully comply with these
Terms and Conditions; (b) technical failures of any kind, including, but not limited to
malfunctions, interruptions, or disconnections in phone lines or network hardware or software;
(c) lost, incomplete, delayed, or misdirected entries or Winner Releases; (d) injury or damage to
entrants’ computers or to any other individual’s computer related to or resulting from
participating in, or downloading any material regarding the Contest or accepting the Prize; (e)
any injury or damage to persons or property which may be caused, directly or indirectly, in
whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of the
Prize, including the use of entries by Superior; (f) the security or privacy of information
transmitted via computer networks or for breaches of privacy due to interference by third-party
computer hackers or otherwise; or (g) lost, misdirected or unsuccessful efforts to notify a
Selected Entrant.
10. PUBLICITY AND PRIVACY
By accepting the Prize, the winner agrees to allow Superior to use
their name, likeness, and entry information for promotional purposes without further notice or
compensation, except where prohibited by law.
Any personal information collected in connection with this Contest will be used and treated in
accordance with Superior’s privacy policy
and website terms and conditions .
11. OTHER TERMS AND CONDITIONS
No P.O. Box addresses will be accepted as a valid
delivery address for the Prize. Except for shipping costs, the Prize’s winner is solely responsible
for any taxes or other costs or expenses associated with the delivery of the Prize to the address
provided by the winner. No responsibility is assumed by Superior for the Prize after it is shipped
and the winner will bear all risk of loss or damage.
Superior reserves the right to cancel, suspend, or modify the Contest or these Terms and
Conditions at any time and in any way, without prior notice to entrants
All intellectual property, including but not limited to trademarks, logos, designs, promotional
materials, web pages, source codes, images, drawings, illustrations, slogans and
representations related to the Contest, are owned by Superior. All rights reserved. Unauthorized
copying or use of any of Superior’s intellectual property without the express consent of Superior
is strictly prohibited.
The decisions of Superior in respect of all matters pertaining to the Contest, including but not
limited to eligibility, validity, contents, or disqualification of an entry, shall be final and binding
without right of appeal.
12. GOVERNING LAW
The Contest is governed by the laws of the Province of Ontario and the
federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of
law rules. Any dispute in connection with the Contest shall be adjudicated by a court of
competent jurisdiction in Ontario.
